Propose an inventive idea

Following the amendments to the Industrial Property Code, introduced by Law no. 102/2023, the principle of individual ownership (so-called professor's privilege ) was abolished, which attributed exclusively to the inventor the rights deriving from the patentable invention and the possibility of filing the application independently, after informing the administration to which he belongs.

With the new reform, the rewriting of art. 65 CPI has established the institutional ownership of such rights and an obligation, on the part of the inventor, to communicate the inventive idea to the structure to which he belongs, which, within six months of receiving it, is required to file the patent application or inform the same of the lack of interest in proceeding with it.

If the Institution does not act within the time limit due to inertia or lack of interest, the inventor may independently proceed to file the patent application in his own name.

 The inventor who has created a technological invention is required to submit the Patent Application by filling in the appropriate form (so-called Disclosure Form ).
