Monday, February 2, 3:00 p.m.: Conference on ADMINISTRATIVE TRANSPARENCY - Access to documents and measures to ensure legality

Transparency and legality are fundamental principles of public administration action, but both can be interpreted in different ways. Since the legislature protects conflicting public interests, the reference to formal legality is not sufficient to guarantee the correctness of administrative action. Therefore, in the exercise of discretionary power, it is necessary to introduce additional evaluation criteria, which must be predetermined and known, in order to ensure effective transparency. However, to make administrative action more effective and expeditious, the appointment of commissioners for the provision of goods and services, granting them exceptional powers extra ordinem, is increasingly being used. For this reason, the PRIN 2022 Public administration for development: substitute powers, guarantee and efficiency needs analyzes whether and how commissioners make administrative activities more efficient while still ensuring legality. For this reason, the Mediterranea Research Unit (headed by Professor Manganaro, members Professors Tropea, Caracciolo La Grotteria, and Parisi) is organizing a second conference as part of the research project, identifying two sensitive areas: the right of access to public contracts and the regulation of anti-mafia reporting in relation to local authorities. The conference, attended by university professors, administrative judges, lawyers, and experts in the field, will take place on Monday, February 2, at 3:00 PM in the Aula Magna Quaroni , given the impediments caused by work at the DiGiES headquarters.
